I plan to apply test optional if I can but I know UGA and GT do not offer that

I assume you are here because a parent has a work visa. The problem is going to be meeting budget of 40k. If georgia will give you instate tuition, you go to the best in state in Georgia. The policy seems to vary by institution. Otherwise, expect to pay OOS rates or worse, intl rates. Your first focus is cost, if the budget is 40k.
I don’t think Northeastern would meet your budget constraint. In addition to the tuition, Boston rents are very high. If you do apply there, I would recommend test optional. My son is a recent NU grad. His ACT was 34, which equates to 1490 SAT.

Yea to IU but not business. No shot if $40k needed so you shouldn’t apply.
No to UIUC but it won’t hit budget anyway.
Yes to FIU. But once you move off campus it’s likely to go over $40k.
RIT - maybe but you are below the aversges and it won’t hit budget.
You are better to apply to Georgia directionals if get in state, like Southern or Valdosta assuming they’ll meet costs or UT Chattanooga, W Carolina or similar - assuming you may qualify for domestic costs. If not check international costs at each.
Picking schools that won’t hit $40k is a waste but you also picked ones you won’t get into.
How long have you/your family lived in the US? Do they plan to return to their home country?
“ International students who reside in the United States under non-immigrant status conditioned at least in part upon intent not to abandon a foreign domicile shall not be eligible for in-state classification.”
This implies H1B or L visas (dual intent visas) would qualify for in state tuition, whereas clear non-immigrant visas like TN visas wouldn’t. Should all be checked with the college of course. Note that it is the status (rather than the intent of the parents) that seems to be the defining issue.
If this is the case Ga has ample schools outside of UGA and Ga Tech - from Kennesaw, to N Georgia, W Georgia, Ga Southern, Valdosta, Ga State, and Ga College and State U. I work with many and they have the same jobs and levels as the UGA, Ga Tech, and Emory people - some higher even.
And I think UTC will work - it’s very popular today.
Although, also note there is a potential snag if the student turns 21 during their studies (and if they have not received a green card by then), at which stage they will no longer qualify as dependent on the parent visa and will have to get a student visa/status to continue studying; the F student visa is also a non-immigrant visa and would therefore disqualify them from instate tuition.
It’s no issue. The student is not getting into UGA or Ga Tech.
Other Ga schools like Ga Southern are affordable for international as is W Carolina. UT Chatt is like $45k with insurance etc for into but may have merit.
There are schools for this student. But they will need to be less selective but their initial list was not only admit aggressive but most important cost impossible.
