So being from a “good family” means you shouldn’t be charged with or convicted of rape - even when you confessed the act to your friends by the video you sent them? I have no words at all. It’s not only crazy news that I expected to find out was “fake,” it’s “boggle my mind” news in a way few other stories can.
@VaBluebird I agree, though “sick” seems too mild of a word for it. How can any judge think such a thing? It makes me wonder what he did in his past that he’s relating to. So much for justice being blind if you come before him.

@Creekland, the judge didn’t rule that he couldn’t be charged with or convicted of rape; he ruled that he could not be charged with that crime as an adult.
He did make some incredibly offensive statements when he made his ruling. To me, worse than the “comes from a good family” nonsense was that “traditional rape” usually consists of "2 or more men two or more males using a gun or weapon to corner a victim into an abandoned house, shed or shack, and just simply taking advantage of the person as well as beating the person, threatening the person.” Okay, so all of the solitary rapists are somehow only guilty of a lesser sexual assault rather than “traditional rape.”
He used the same defense of his comments as many here on CC do-that she shouldn’t have been drinking, she went into the room with him willingly. Pull up any rape thread here at CC and you will see the same victim blaming arguments made, as well as the objections to “ruining a young man’s life”. Then there is the whole “women lie” thing that permeates every thread. Point is this kind of thing is not that surprising or unusual or “crazy.”
His ruling was overturned, but that only means that the grand jury can consider the prosecutor’s recommendation to try him as an adult. The case will likely go on for a long time.
To me it’s crazy. I hope I never think otherwise.
In this case (according the the snippet we saw), the dude sent a video of the act to his friends calling it rape, so he had to have known what he was doing. Assuming that part is true, I don’t really need any other evidence or reasons, pro or con.
@Creekland we are in agreement on everything except the one fact that was incorrect about the judge’s ruling. The official ruling was simply whether or not to prosecute as an adult or a juvenile. His ruling had no authority to decide whether or not he should be charged or convicted, I was glad to see that the appellate court overruled him and that they also took great issue with the fact that he went on to comment about other things which he had no business discussing in his ruling; his task was was simply to decide whether or not to allow the prosecutors to charge the perpetrator as an adult. It’s clear to me that if he were to be the judge in the actual criminal complaint, justice would likely not be served with his sexist and antiquated notions.
Personally I might understand (though not necessarily agree) with the argument that young people are redeemable, therefore juveniles should be charged as juveniles. But he didn’t stop there. Suggesting that because this young man came from a" good family," had high test scores, went to a prestigious school, etc ., he should be treated more leniently reeks of elitism, because I highly doubt he would make the same case for a juvenile of color, who didn’t come from “a good family” and didn’t have high test scores.
As to whether all this is crazy: rape apologist rhetoric may be crazy, but unfortunately it’s not uncommon.
Yesterday while eating lunch at a table with a view of the ocean, we saw a small inflatable toy drifting rapidly from one end of the beach to the other with no adult nearby until the float almost reached a rock wall. An adult appeared and intercepted the float which contained a very young child or maybe age 5 and he escorted boy and float to shore. We figured that adult thought it was cool and fun allowing the child to float unattended in the deep water of the current with no one near.
There are so many ways that could have gone wrong—my dining companion and I were astounded. There was no way that child could have had any assistance if anything went amiss—no one was near him.
